These General Terms and Conditions of Sale govern the distance selling relationship between COOL FAT GUY S.L. and the user or customer placing orders shipped to the United States, in accordance with applicable Spanish law and current e-commerce regulations.

COOL FAT GUY S.L. reserves the right to modify these terms at any time. The terms in force at the time the order is placed shall apply.

The purpose of this website is the online sale of clothing and accessories.

The user declares that they are of legal age, have full legal capacity to contract, and expressly accept these Terms and Conditions of Sale.

ACCEPTANCE OF THE CONTRACT

Placing an order implies express and unconditional acceptance of these Terms and Conditions of Sale.

The contract shall be deemed concluded at the moment the customer receives the order confirmation by email.

⚠️ IMPORTANT NOTICE ON CUSTOMS CHARGES (USA)

For orders shipped to the United States, the customer is solely responsible for the payment of any import taxes, duties, customs charges or fees that may apply upon delivery.

If the customer rejects the order, fails to pay customs charges, or does not complete the necessary import procedures, the shipment may be held, returned or abandoned by customs authorities.

In such cases:

The order will be considered properly shipped by COOL FAT GUY S.L.
No refund will be issued, either full or partial
COOL FAT GUY S.L. will not assume any costs related to shipping, return, customs handling or destruction of the package
Failure to pay customs charges or refusal of the shipment is not attributable to COOL FAT GUY S.L. and is the exclusive responsibility of the buyer

PRODUCT AVAILABILITY

Product availability may vary depending on demand.
If a product becomes unavailable after purchase, COOL FAT GUY S.L. will inform the customer by email within a maximum period of 30 calendar days, and may offer:

A product with similar or superior characteristics, or
A refund of the amount paid, as applicable

PRICES, TAXES AND DUTIES

All prices displayed for orders shipped to the United States are expressed in U.S. dollars (USD).

Important notice:

Orders shipped outside the European Union may be subject to import taxes, duties and customs fees, which must be paid entirely by the customer upon delivery.

These amounts are NOT included in the product price or shipping costs.

Such charges are determined by U.S. customs authorities, and COOL FAT GUY S.L. has no control over or responsibility for them.

Promotional codes are valid only for full-price products, unless expressly stated otherwise, and cannot be combined with other promotions.

SHIPPING AND DELIVERY COSTS (USA)

COOL FAT GUY S.L. ships to the entire United States under the following conditions:

Standard shipping to the USA: USD 12 (≈ 210 MXN)
Free shipping: orders over USD 288 (≈ 5,000 MXN)

⏱ Estimated delivery time:
Between 5 and 15 business days, depending on logistics and customs clearance processes.

Important:

The cost of the first shipment is partially subsidized by COOL FAT GUY S.L.
The actual international shipping cost exceeds USD 12
The customer shall always bear import taxes, duties and customs charges

SIZE EXCHANGES (USA)

Size exchanges are accepted, but they are NOT free of charge.

Exchange cost:

USD 72 (≈ 1,250 MXN)
+ applicable import taxes and duties, payable by the customer

The customer must request the exchange by emailing info@coolfatguy.com within 30 calendar days of receiving the order.

Conditions:

All costs derived from the exchange shall be borne by the customer
The product must be:
- Unworn
- In perfect condition
- With original tags attached

Recommendation:

We strongly recommend using the size recommendation tool available on the website and responding to all size confirmation emails sent by COOL FAT GUY S.L., in order to avoid additional costs.

RETURNS (USA)

Returns are accepted, but they are NOT free of charge.

Return cost:

USD 32 (≈ 550 MXN)
+ applicable import taxes and duties, payable by the customer

Customs charges may amount to approximately 20% to 30% of the order value, depending on applicable regulations.

The customer must notify the return by emailing info@coolfatguy.com within 30 calendar days of receiving the order.

REFUNDS

Products purchased at full price:

Refunds will be issued using the same payment method used for the purchase
Maximum refund period: 30 calendar days from receipt of the returned product
Usual processing time: 10 to 15 business days

Products purchased during sales, promotions, Black Friday or special offers:

No monetary refunds will be issued
The amount will be refunded exclusively as a store credit coupon

DEFECTIVE PRODUCTS

In the event of a defective product not attributable to the customer, COOL FAT GUY S.L. will assume the return costs and will proceed with the replacement of the product or the corresponding refund.

PAYMENT METHODS

Payment may be made by credit or debit card (VISA / MASTERCARD) through the secure Stripe platform.

Banking details are not stored on COOL FAT GUY S.L. servers.

JURISDICTION AND APPLICABLE LAW

The relationship between the user and COOL FAT GUY S.L. shall be governed by Spanish law.

In the event of any dispute, the parties expressly submit to the courts and tribunals of Castellón (Spain), waiving any other jurisdiction.
