These General Terms and Conditions of Contract regulate the distance selling relationship between COOL FAT GUY SL and the user or customer who places orders destined for Mexico , in accordance with current regulations in Spain and the applicable regulations on electronic commerce.

COOL FAT GUY SL reserves the right to modify these conditions at any time, and the conditions in effect at the time of placing the order will apply.

The purpose of the website is the online marketing of clothing and accessories .

The user declares to be of legal age, to have sufficient legal capacity to contract and to expressly accept these terms and conditions of sale.

ACCEPTANCE OF THE CONTRACT

Placing an order implies express and unreserved acceptance of these Terms of Sale.

The contract will be considered perfected when the customer receives the order confirmation by email .

⚠️ IMPORTANT NOTICE REGARDING CUSTOMS FEES (MEXICO)

For orders destined for Mexico, the customer is solely responsible for the payment of taxes, duties and customs fees that may apply at the destination.

If the customer refuses the order , does not pay the customs fees , or does not complete the necessary import procedures , the order may be held, returned, or abandoned by the customs authorities.

In these cases:

• The order will be considered correctly shipped by COOL FAT GUY SL

• No refunds will be issued , either in full or in part.

• COOL FAT GUY SL will not assume the costs arising from shipping, returns, customs or destruction of the package

Failure to pay customs fees or rejection of the order by the customer does not constitute a cause attributable to COOL FAT GUY SL and will be the sole responsibility of the buyer.

PRODUCT AVAILABILITY

Product availability may vary depending on demand.
In case of unavailability after purchase, COOL FAT GUY SL will inform the customer by email within a maximum of 30 calendar days , and may offer:

• A product with similar or superior characteristics, or

• The refund of the amount paid, as applicable.

PRICES, TAXES AND TARIFFS

All prices shown for orders destined for Mexico are expressed in Mexican pesos (MXN) .

Important notice:

Orders shipped outside the European Union may be subject to import taxes, duties and fees , which must be paid in full by the customer at the destination .

• These amounts are NOT included in the product price or shipping costs.

• Mexican customs authorities determine these amounts.

• COOL FAT GUY SL has no control or responsibility over them.

Promotional codes will only be valid for full-price products, unless expressly stated otherwise, and cannot be combined with other promotions.

DELIVERY AND TRANSPORTATION COSTS (MEXICO)

COOL FAT GUY SL ships to all of Mexico under the following conditions:

• Standard shipping to all of Mexico: MXN 210

• Free shipping: orders over 5,000 MXN

⏱ Estimated delivery time: between 5 and 15 business days , depending on logistics and customs processes.

Important:

• The cost of the first shipment is partially subsidized by COOL FAT GUY SL

• The actual cost of international transport is over 210 MXN.

• The customer will always assume taxes, duties and import expenses.

SIZE EXCHANGES (MEXICO)

Size exchanges are accepted, but not free of charge .

Cost of change:

• 1,250 MXN

• + import taxes and duties , payable by the customer

The customer must request the change by writing to info@coolfatguy.com within 30 calendar days from receipt of the order.

Conditions:

• All expenses arising from the change will be borne by the customer.

• The product must be unused, in perfect condition and with original tags.

Recommendation:

It is strongly recommended to use the size recommender available on the website and to reply to the confirmation emails sent by COOL FAT GUY SL, in order to avoid additional costs.

RETURNS (MEXICO)

Returns are not free .

Return shipping costs:

• 550 MXN

• + import taxes and duties , payable by the customer

Customs duties can range from approximately 20% to 30% of the order value , depending on the applicable regulations.

The customer must notify info@coolfatguy.com of the return within 30 calendar days from receipt of the order.

PAYMENT REFUND

Products purchased at full price:

• The refund will be issued via the same payment method used.

• Maximum period: 30 calendar days from receipt of the returned product.

• Usual processing time: 10 to 15 business days .

Products purchased during sales, promotions, Black Friday or special offers:

• No monetary refund will be issued .

• The amount will be refunded exclusively via a purchase voucher .

DEFECTIVE PRODUCTS

In the event of a defective product due to a cause not attributable to the customer, COOL FAT GUY SL will assume the return costs and proceed to replace the product or issue the corresponding refund.

PAYMENT METHODS

Payment can be made by credit or debit card (VISA / MASTERCARD) through the secure Stripe platform.

Bank details are not stored on COOL FAT GUY SL servers

JURISDICTION AND APPLICABLE LAW

The relationship between the user and COOL FAT GUY SL will be governed by Spanish law .

In case of conflict, the parties expressly submit to the courts and tribunals of Castellón (Spain) , waiving any other jurisdiction.
